Delegated authority
Power passed from a legislature to a regulator, or from a regulator to an SRO, to make and enforce rules on its behalf.
Overview
Legislatures delegate rulemaking to regulators, and regulators sometimes delegate member regulation to SROs. The delegating body keeps oversight and can usually withdraw the delegation.
It connects most directly to Statutory authority, Self-regulatory organisation and Rulemaking.
Check the official sources below for legal scope, applicable dates and exceptions. This entry is an explanatory reference, not legal advice.
Why it matters
Delegation is why so much binding law is written by bodies that voters never elect.
Who it affects
All regulated organisations, and SRO members in particular.
